Introduction

The Immigration Program for Refugees and Persecuted Persons administers the Protection Visa 866. But only those who fit the criteria for refugee immigration are granted this kind of visa by Australia.

What Is a Subclass 866 Protection Visa?

This visa is for people who arrived in Australia on a valid visa and want to seek asylum. It lets you stay in Australia permanently if you engage in Australia’s protection obligations and meet all other requirements for the grant of the visa.

For Whom Is a Protection Visa 866 eligible?

If you fit one of these criteria, you may apply for this visa:

  • A refugee.
  • A person who satisfies the additional protection requirements.

Conditions for Eligibility

In order to qualify for a protection visa, you must also:

You fit the requirements for supplemental protection or you are a refugee.

None of the following applies to you:

  • Subclass 785 of the Temporary Protection Visa.
  • Subclass 449 of the Temporary Safe Haven Visa.
  • Subclass 786 of the Temporary (Humanitarian Concern) Visa.
  • Subclass 790 of the Safe Haven Enterprise Visa.

Applying for a protection visa 866 is not prohibited. A protection visa application cannot be submitted if:

  • Since your last arrival in Australia, a protection visa has been denied to you.
  • A visa for protection was revoked for you.
  • You hold two or more citizenship.
  • Another secure third country is protecting you.

Application Process for Australia Protection Visa 866

There are two ways to apply for an Australia protection visa:

  • Via the visa service online.
  • Through a paper application.

Apply via the Visa Online Service

You must create an ImmiAccount in order to submit the necessary paperwork and complete the online visa application. As you continue, you can adhere to the directions provided by the internet service. The visa fee must be paid in order to process your application after you’ve turned in your supporting documentation and completed the visa application. You have the choice to post a written statement via your ImmiAccount describing who is aiding you and why if someone is assisting you with your application.

Use a Paper Application Form to Apply

In this scenario, you must complete the application form and submit it along with your other supporting documentation. The application must be mailed to the address listed on your application form. There are no in-person submissions, and your application won’t be approved if you mail it to a different address. You must still use an ImmiAccount to submit your payment for your visa fee.

Getting Your Documents Ready

Your documentation must be prepared in accordance with the Department’s requirements regardless of how you apply. You must get your documents translated by the National Accreditation Authority for Translators and Interpreters if they are not in English. Following a Protection Visa Application

You will receive written notice of the visa decision following the approval of your application. In order to utilize it as a travel document, you can then apply for an Immicard. If your visa application is rejected, you will receive a letter outlining the reasons why and instructions on how to request a review of the decision. 

The Immigration Department may occasionally invite you to a visa interview. They will inquire about your circumstances, the reasons you are asking for a visa, the details you submitted in your application, and more during the interview. It’s crucial that the information you include in your application and the responses you provide in your interview line up.

What Is the Price of a Protection Visa 866?

A protection visa application costs AUD40. There is no additional price for submitting a subsequent application or for bringing additional applicants with you. The non-internet fee for your paper application is also not required.

 

Processing time for 866 Protection Visa

An application for a protection visa cannot be processed in a specific amount of time. The Australian Immigration Department does make an effort to complete your application as quickly as possible, though.

When Does a Protection Visa 866 Expire?

A visa of protection The 866 visa is an ongoing, perpetual document. However, an 866 visa has a 5-year travel expiration period, exactly like any other Australian permanent visa.

Can I Include My Family Members With Me on a Protection Visa?

You can include family members if they are the family’s head:

  • Spouse.
  • A de facto partner.
  • A dependent child or step-child.
  • A dependent child or step-child of the spouse/partner.

Other family members include:

  • A parent.
  • A sister or brother.
  • A grandparent or grandchild.
