Proving Your De Facto Relationship: A Detailed Guide

Applying for an Australian partner visa can be challenging, especially when you are in a de facto relationship rather than legally married. To convince immigration authorities that your relationship is genuine, you need to thoroughly demonstrate that you and your de facto partner have been living together in a bona fide domestic partnership.

This in-depth guide provides everything you need to know to apply for a partner visa. We will also tackle how to prove a de facto relationship to maximise your chances of visa approval.

What is a De Facto Relationship?

Let’s start by clarifying what constitutes a de facto relationship in the eyes of Australian immigration. A de facto couple refers to two persons living together in a relationship as intimate as a marriage but without getting formally married under law.

To be eligible for a partner visa as de facto partners, you and your de facto partner must prove that your day-to-day lives are fully integrated, including:

  • Cohabiting under the same roof for an extended period of time.
  • Having a mutual commitment to an exclusive and genuine relationship.
  • Providing each other with financial support.
  • Sharing responsibility for domestic duties and household management.
  • Making joint decisions regarding social and recreational activities.

In other words, you must demonstrate that you and your de facto partner share practically every aspect of your lives together, despite not being legally married. Your relationship should mirror a marital union in all facets except the official certificate.

Immigration will look for evidence that you operate as a single economic and social unit, where your lives are completely intertwined, finances combined, and futures interdependent. This is how you prove a bona fide de facto relationship.

How Long Do You Need to Be in a De Facto Relationship?

One formal rule for all de facto partner visa applicants is demonstrating that you have lived together with your partner for at least 12 months before applying. This minimum 12 month relationship period provides clear evidence that you have established a settled domestic life together.

Shorter relationships may sometimes be accepted, but you would need to provide compelling reasons. For example, the 12-month requirement can be waived if:

  • Your de facto relationship is formally registered under the law of an Australian state or territory that provides for this option. Being on a relationship register demonstrates a serious level of commitment.
  • The laws of your home country prohibit cohabitation with your same-sex or unmarried partner. In this case, you lived together whenever possible despite legal impediments.
  • Other special circumstances prevented cohabitation for a full 12 months, such as a partner’s military deployment, temporary work assignment, or caregiving obligation.

As long as you can explain legitimate reasons for not meeting the 12-month rule, immigration may grant an exemption. But the expectation is that applicants will satisfy this baseline relationship period.

How to Prove Your De Facto Relationship for Partner Visa

Proving De Facto Relationship

While the duration of cohabitation is a key factor, immigration authorities also carefully examine the quality and genuineness of your partnership. They want to see that you and your de facto partner demonstrate a bona fide de facto relationship in all respects.

To convince immigration officers that your relationship is real, you must submit compelling evidence across four fundamental aspects:

Commitment Aspects

A major indicator is showing long-term commitment between you and your partner, such as:

  • Being in the relationship for multiple years, not just barely 12 months.
  • Making serious plans to marry, have children, or purchase property together.
  • Discussing your future life plans as a couple.
  • Knowing intricate details about each other’s personal histories, families, and childhood stories beyond surface-level information.
  • Supporting each other during difficult times or separations.

Lengthy relationship duration and extensive knowledge of your partner’s life circumstances indicate deep commitment.

Cohabitation

At a minimum, you need to provide documentary proof that you and your de facto partner live together – 12 months or longer. Exact evidence includes:

  • A joint lease agreement or property title showing co-ownership on a house or lodge.
  • Jointly paying for rent, mortgage, utilities, and other household expenses.
  • Official government or tax documents listing the same address for both of you.
  • Bills, bank statements, and other mail received at the shared home address.

The more paper trails confirming cohabitation, the better.

Financial Aspects

An interdependent financial life is a key sign of genuine partnership. Compelling evidence includes:

  • Joint bank accounts and credit cards.
  • Co-owning major assets like vehicles, property, or other investments.
  • Being listed as the beneficiary on your partner’s insurance and superannuation.
  • Shared debts and liabilities, such as joint loans or mortgages.
  • Mutually paying for or splitting bills and everyday living costs.

Thoroughly demonstrate that you and your de facto partner plan finances together, combining resources to support each other.

Social Aspects

You also need to prove to others that you are in a committed domestic relationship. Solid evidence includes:

  • Tell family and long-term friends about your de facto partnership.
  • Appearing as a couple at weddings, holidays, and other social events.
  • Making joint travel plans for vacations and trips.
  • Showing visible displays of affection for your partner in public.
  • Posting about your de facto relationship on social media accounts.
  • Being identified as your partner’s de facto spouse in documents like health insurance paperwork

Provide testimonials confirming your life as an established couple to mutual acquaintances to prove your relationship is genuine and continuing up to this day.

I trusted Parish Patience with my migration and skills assessment process and unfortunately had a very disappointing experience. Initially, I was advised by Mr Golam and Upasana to proceed with my Subclass 485 pathway. Based on their advice, I paid for skills assessment and also completed a PTE exam. However, I later found out that an important requirement for my VETASSESS application — having at least one year of relevant post-qualification work experience — had not been clearly explained to me before lodging the application. My application was submitted using work experience from before my studies and the outcome was negative. After that, I was advised that applying through Engineers Australia using the CDR pathway would be easier and would give me a better chance of receiving a positive skills assessment outcome. I followed their advice again, paid additional fees, but unfortunately received another negative outcome. During this process, two separate Subclass 485 visa applications were lodged and later withdrawn. I experienced significant financial loss through application fees, assessments, and English testing costs. I was fortunate that I still held a valid student visa, which made it possible to withdraw the applications without further complications. From my personal experience, I felt the communication, assessment of eligibility, and overall service quality were poor. I also did not receive any compensation or satisfactory resolution for the losses I experienced. I hope future clients receive clearer advice about eligibility requirements and possible risks before committing financially.
