    A permanent child visa also allows the child to apply for citizenship if eligible. To qualify for a permanent child visa, the parent should be an Australian or New Zealand citizen or resident.

    Do you and your dependent child qualify? Take a good look at these key requirements for the 101 Australian visa.

    • As the sponsoring parent, you must be an Australian citizen, an eligible New Zealander, or a current holder of an Australian permanent visa.
    • The child can be either of the:
      • Biological Child
      • An adopted child who has been adopted before turning 18 by a parent who was not (yet) an Australian citizen or permanent resident at the time.
    • Stepchild from an ex-partner, and the stepparent must have custody or guardianship rights over the stepchild.
    • The child must have an approved sponsor, such as a parent or the de facto partner or spouse of the parent.
    • The child must be under 18 or, if over 18 but under 25, must be studying on a full-time basis, or if over 18, is physically or mentally handicapped and cannot do work full-time.
    • The child must NOT have been previously married, let alone been in a de facto relationship.
    • The child must be healthy and, if 16 years old and up, must also have no criminal record.
    • Children 18 and older must sign the Australian Values statement, pledge to follow Australian laws, and read or have someone explain to them the Life in Australia booklet.
    • The child must secure prior consent to move to Australia, such as a legally binding written document from everyone who can decide where the child should live, and that the laws of the child’s country of birth permit them to move.
    • The child’s migration to Australia must be in his or her best interests.

    For the actual application, you must then supply all the necessary documents in line with the above-mentioned eligibility requirements.

    101 Visa Processing Time Australia

    Since the application has to be lodged outside Australia, processing times for a child visa 101 are typically longer than for an 802 visa lodged onshore. For 75 per cent of applications, it could take up to 8 to 15 months, while 90 per cent of applications are finalised even longer, up to 13 to 24 months.

      Can I apply for a child visa 101 on my child’s behalf?

      You can apply for a subclass 101 Australia visa if your child is under 16 and cannot do the application on his or her own. Your child can also authorise you to handle the application process and submit a Form 956A. But it’s still advisable to contact the Department or consult with an Australian migration agent for proper guidance and advice.

      Can my child travel outside Australia on this visa?

      A 101 visa in Australia has a travel facility of up to five (5) years. Your child can leave Australia and travel to another country while this visa’s travel facility remains valid. Once it expires and your child wants or needs to travel outside Australia, he or she will need to apply and be approved for a resident return visa so as not to negatively impact the child’s PR visa status.

      Can I apply online for a child visa 101 Australia?

      Application for a child visa subclass 101 shall be made outside Australia and via paper only. Having said so, online applications are currently unavailable. However, applicant can import their application into ImmiAccount once DOHA acknowledges that they have received the application. Importing an application into ImmiAccount gives applicants access to a range of online services that make it easier to manage their application.

      What is the difference between a child visa 101 and 802?

      Both are permanent child visas. The main and only difference is where the application is lodged. The subclass 101 visa is for offshore applicants (outside Australia), whereas the subclass 802 visa is for onshore candidates (applying in Australia). 

      What is a bridging visa for a child visa 101?

      A bridging visa allows child applicants to be in Australia legally while their visa is still being processed. But since an Australia 101 visa is for offshore applicants who need to be outside Australia during application, the child will need to apply for another valid visa in order to enter Australia.

      I trusted Parish Patience with my migration and skills assessment process and unfortunately had a very disappointing experience. Initially, I was advised by Mr Golam and Upasana to proceed with my Subclass 485 pathway. Based on their advice, I paid for skills assessment and also completed a PTE exam. However, I later found out that an important requirement for my VETASSESS application — having at least one year of relevant post-qualification work experience — had not been clearly explained to me before lodging the application. My application was submitted using work experience from before my studies and the outcome was negative. After that, I was advised that applying through Engineers Australia using the CDR pathway would be easier and would give me a better chance of receiving a positive skills assessment outcome. I followed their advice again, paid additional fees, but unfortunately received another negative outcome. During this process, two separate Subclass 485 visa applications were lodged and later withdrawn. I experienced significant financial loss through application fees, assessments, and English testing costs. I was fortunate that I still held a valid student visa, which made it possible to withdraw the applications without further complications. From my personal experience, I felt the communication, assessment of eligibility, and overall service quality were poor. I also did not receive any compensation or satisfactory resolution for the losses I experienced. I hope future clients receive clearer advice about eligibility requirements and possible risks before committing financially.
