How to Apply for an Orphan Child Visa in Australia

Ensure 100% visa success by taking into account the following step-by-step application process:

    1

    Step One

Evaluate the child’s basic eligibility first. Check the passport if it’s still valid. Appoint an Australian immigration agent or lawyer to apply on your behalf, should you need it.

    2

    Step Two

Compile all documents needed to support the child’s application, from identity documents such as a passport, travel document, photos, proof that the child has no parent to provide care for them, and relationship evidence with you.

    3

    Step Three

Once you’ve gathered all pertinent documents, submit your application by paper as online lodgements are currently not accepted for this visa type. The child must be outside Australia at the time a decision is made. You must also pay the fees first online, as you will need to attach the payment receipt to your application.

    4

    Step Four

Wait for the Department to notify you if they need more information to further evaluate your application, or if you need to undergo a health examination and/or biometrics. You must duly inform the Department if you have made mistakes in your application or if there are changes in your current circumstances.

    5

    Step Five

Finally, anticipate whether or not your application is approved or otherwise denied. If granted, the Department will write you a letter confirming the date you can fly to Australia, alongside other key information. If denied, they will also let you know why. You can file an appeal at the Tribunal or consult with a professional to help you reapply or explore other visa options.

      Frequently Asked Questions (FAQs)

Who can apply for an orphan visa Australia?

An Orphan Relative Visa is for children under 18 who are from outside Australia and have no parent to care for them because their parents are deceased, permanently incapacitated, or of unknown whereabouts. The child must have a relative in Australia who is an AU citizen, permanent resident, or eligible New Zealander willing to sponsor them.

What are the requirements to sponsor an orphan relative?

To sponsor an orphan relative, you must be the child’s relative or the spouse/de facto partner of the child’s relative. You must also be settled in Australia as either a citizen, permanent resident, or a qualified New Zealander. Additionally, you need to have the capacity to provide for the child’s accommodation, welfare, and other needs.

How long does the orphan relative visa process take?

Processing times differ based on several factors, including the completeness of the application, how quickly you respond to any requests for additional information, and the number of applications being assessed. In general, processing times can take from 28 to 72 months. It’s critical to provide all required documents promptly to avoid delays.

Can an orphan relative study and work in Australia with this visa?

Yes, holders of an orphan relative visa are entitled to residency, education, and employment privileges in Australia.

What is the age limit for an orphan relative visa?

The orphan relative applicant must be under 18 years of age during application, or that the application must be lodged before the child turns 18. If the applicant is over 18, consider consulting with a migration lawyer or agent to explore other visa types that your relative may be best eligible for.

I trusted Parish Patience with my migration and skills assessment process and unfortunately had a very disappointing experience. Initially, I was advised by Mr Golam and Upasana to proceed with my Subclass 485 pathway. Based on their advice, I paid for skills assessment and also completed a PTE exam. However, I later found out that an important requirement for my VETASSESS application — having at least one year of relevant post-qualification work experience — had not been clearly explained to me before lodging the application. My application was submitted using work experience from before my studies and the outcome was negative. After that, I was advised that applying through Engineers Australia using the CDR pathway would be easier and would give me a better chance of receiving a positive skills assessment outcome. I followed their advice again, paid additional fees, but unfortunately received another negative outcome. During this process, two separate Subclass 485 visa applications were lodged and later withdrawn. I experienced significant financial loss through application fees, assessments, and English testing costs. I was fortunate that I still held a valid student visa, which made it possible to withdraw the applications without further complications. From my personal experience, I felt the communication, assessment of eligibility, and overall service quality were poor. I also did not receive any compensation or satisfactory resolution for the losses I experienced. I hope future clients receive clearer advice about eligibility requirements and possible risks before committing financially.
