Student Visa Working Hours

Student Visa Working Hours Australia 2026: Subclass 500

Last Update

International students frequently voice the same inquiry: “What is the maximum working hour limit for a student visa holder?” Well, it can cost you your visa if you are caught violating the working hours rule on your student visa in Australia. So, let’s clear up the subclass 500 work hours rule limits, when you can work more hours, what kind of activities are considered work, and how to remain compliant. It may seem that the regulations are tough to grasp, ideally, but we promise to elaborate on them with ease. Along with explanations, we offer examples, calculation tips, exemptions, and penalties. At Parish Patience Immigration Lawyers, our primary goal is to make it easy for you to have comprehensive knowledge of your rights and duties, enabling you to work peacefully while studying.

The Core Rule: 48 Hours per Fortnight During Study Terms

This is the foundational principle that you must understand. Student visa holders (subclass 500), whose courses are in session (this indicates that classes and semesters are operating), are allowed to work for a maximum of 48 hours per fortnight.

What is a fortnight?

  • One fortnight = 14 days = two weeks.
  • The fortnight always starts on a Monday and ends on the following Sunday.

Important clarifications:

  • The number of hours is not 24 per week; rather, it is 48 in total for any two weeks in row.
  • You can share the hours in any manner you like, for instance, working 30 hours in Week 1 and 18 hours in Week 2 would equal a total of 48 hours ✅
  • However, you cannot work 25 hours per week and thus make a total of 50 hours in the two weeks ❌

Example:

Mei is doing a rotation of shifts on Monday to Wednesday for 15 hours the first week and then on Monday to Friday for 35 hours the second week, which adds up to 50 hours in total for the two weeks. That exceeds her maximum allowed hours.

This rule is indicated in visa conditions 8105 (for main applicants of the student visa) and 8104 (for those on dependent visas).

Complete Calculation Guide: How to Stay Compliant

What Hours Count at Work

Maintaining adherence to your 48-hour work limit per fortnight is a very easy task when you use a well-defined method. A very practical and straightforward guide is provided below which will assist you in getting the perfect count and will help you in staying away from unintentional violations.

Step 1: Pick Your Fortnight

Select the Monday on which you want to start counting and then count 14 days. The time frame of your fortnight always starts on Monday and ends on Sunday over a period of two consecutive weeks.

For instance: Monday 1 June – Sunday 14 June.

Step 2: Record Every Hour You Work

Make a note of the total hours you worked throughout the fortnight. Don’t forget to include:

  • All jobs (even if it’s a combination of several jobs)
  • Casual, part-time, and full-time work
  • Paid internships or placements (unless specifically exempt)

Step 3: Calculate Total Hours for the Fortnight

Add up all the hours from every employer. Your total must not be more than 48 hours. If you exceed this limit, you have violated the conditions of your visa.

Actual Calculation Example:

  • Week 1 Total: Restaurant 34 hrs + Tutoring 4 hrs = 38 hrs
  • Week 2 Total: Restaurant 30 hrs + Tutoring 2 hrs = 32 hrs
  • Fortnight Total: 38 + 32 = 70 hrs ❌ BREACH
  • This student was over the limit by 22 hours.

Compliance Pro Tips:

  • Monitor hours with a spreadsheet or an app
  • Every Monday, initiate a new computation
  • Maintain documents for disputes with employers
  • As soon as you reach the 48-hour limit, inform your employer.

When You CAN Work Unlimited Hours (The Exceptions)

One of the best consequences, if optimised during specific conditions, is the flexibility to work whenever and however much one wants.

Exception 1: During Official Course Breaks

If your education provider has announced a break (semester break, holiday break, or summer vacation), then you can work without restrictions on hours.

Example: Just imagine Raj; his summer break starts on December 15th and ends on February 15th. He is allowed to work for the whole two months.

Exception 2: Master’s by Research / PhD Students

If you are a student of a Master’s by Research or a Doctorate degree, then you will not be subjected to the 48-hour limitation once your course has started.

Exception 3: Mandatory Course Placements

Hours spent in a necessary work placement or internship mentioned in your CRICOS course will not be counted towards the 48-hour limit.

Exception 4: Unpaid Work/Volunteering

Normally, unpaid volunteer work does not count as part of the 48-hour limit. However, it should be noted that if you receive any payment (even if it is partial) it will be counted.

Exception 5: After Course Completion.

When your last evaluation is done, and your visa is still valid, you will likely be allowed to work unlimited hours until your visa expires. A lot of students are waiting for a graduate visa pathway under such circumstances.

What Counts as “Work” (And What Doesn’t)

It’s essential to know which activities count towards work hours and which ones do not.

Counts Toward the 48-Hour Limit:

  • Casual or part-time jobs
  • More than one job (total hours are counted)
  • Self-employment (if the individual receives payment)
  • Paid internship or placement (unless excluded)
  • Freelance or contract paid work
  • Rideshare/delivery paid work
  • Online tutoring (paid)

Does Not Count Toward the Limit:

  • Volunteering without pay
  • Uncompensated mandatory internships for credit
  • Academic fees (taking classes)
  • Positions in student government (if no payment)
  • Research without pay

Important note: Despite the wages earned under ABN or TFN for two different jobs, they might complement each other according to their fortnightly cap.

Serious Penalties for Breaching Work Hours (Know the Risk)

Breaking the work-hour limit is not a small slip; it carries serious consequences.

What Happens if You Exceed 48 Hours:

Stage 1: The Department of Home Affairs might notify you of a data breach. They could reach out to you or your employer and put out a cautionary notice.

Stage 2: There is a possibility of visa suspension or cancellation taking place even without prior notice. You might have to vacate the country instantly.

Stage 3: Future visa applications may be turned down; a 3-year re-entry ban might be imposed on you. This will also affect your potential study or work visa.

Stage 4: In the most difficult situations, the cost of removal from the country will be imposed on you along with deportation.

For example, Yuki worked for over 48 hours for a specific fortnight. This hard dealing led to the cancellation of his visa and placed him at risk for a 3-year ban.

Why this matters: A few extra hours of work aren’t “just minor” – they can trigger a breach of visa condition 8105 (or 8104) and jeopardise your entire stay and future.

How to Calculate & Stay Safe: Practical Strategies

You may not be able to control everything, but you can control how well you manage your time. Here are good tips:

  • Utilise a work-hour tracker: A tool like a spreadsheet or app where you record your shifts, work hours, and job titles every two weeks.
  • Communicate with your company: Inform them about your limit, demonstrate your visa requirement, and reach a pre-agreed maximum hours arrangement.
  • Time your jobs strategically:
    • During heavy study periods, reduce hours.
    • During breaks, you may work full-time safely.
    • Before major exams – keep work low.
  • Verify your visa condition: The VEVO (Visa Entitlement Verification Online) system can be used to ascertain whether your weekly limit is 48 hours or unlimited (according to your course). Study Australia
  • Be aware of your rights: In case of any situation where an employer is trying to persuade you to work over the 48-hour limit, you can report him/her to the Fair Work Ombudsman. You have protection according to the laws regarding the workplace.

Employer Responsibilities: What Your Boss Must Know

If you’re a student worker, your employer also has obligations.

Employers must:

  • Ensure that you have started your course (by means of Confirmation of Enrolment)
  • Follow the 48-hour / fortnight limit rule during the semester
  • Maintain a log of hours worked
  • Adhere to Fair Work standards (minimum pay, safe working conditions)

Students have rights:

  • Proper payment is a right.
  • A safe work environment is a right.
  • Fair Work will receive your reports of breaches and protect you from retaliation.
  • Your protection remains intact even if your employer is not informed about the visa condition.

For Both:

The Fair Work Ombudsman provides free support in the area of pay calculations, workplace rights, and conditions of employment to ensure that both employers and students are on the right side of the law.

I trusted Parish Patience with my migration and skills assessment process and unfortunately had a very disappointing experience. Initially, I was advised by Mr Golam and Upasana to proceed with my Subclass 485 pathway. Based on their advice, I paid for skills assessment and also completed a PTE exam. However, I later found out that an important requirement for my VETASSESS application — having at least one year of relevant post-qualification work experience — had not been clearly explained to me before lodging the application. My application was submitted using work experience from before my studies and the outcome was negative. After that, I was advised that applying through Engineers Australia using the CDR pathway would be easier and would give me a better chance of receiving a positive skills assessment outcome. I followed their advice again, paid additional fees, but unfortunately received another negative outcome. During this process, two separate Subclass 485 visa applications were lodged and later withdrawn. I experienced significant financial loss through application fees, assessments, and English testing costs. I was fortunate that I still held a valid student visa, which made it possible to withdraw the applications without further complications. From my personal experience, I felt the communication, assessment of eligibility, and overall service quality were poor. I also did not receive any compensation or satisfactory resolution for the losses I experienced. I hope future clients receive clearer advice about eligibility requirements and possible risks before committing financially.
