Employer Nomination Scheme Subclass 186: What You Need To Know

Permanent residency permits for skilled employees are known as Employer Nomination Scheme (ENS) visas, also known as subclass 186 visas. Both people living outside of Australia and those who are currently working and residing in Australia as temporary residents are eligible to apply.

A skilled individual must be proposed by an Australian company in order to qualify for this visa. A permanent employer-sponsored visa is the Employer Nomination Scheme Visa Subclass 186. This visa’s objective is to enable Australian businesses to suggest highly qualified workers for permanent residence.

How Is 186 Employer Nomination Scheme Visa Obtained?

An employer nominated scheme visa subclass 186 can be obtained in two steps as follows:

  • Nomination – The employer is required to submit a nomination that explains the position’s requirements and names the nominee.
  • Visa Request – The applicant submits a Subclass 186 visa application under the appropriate stream.

Important Eligibility Criteria

  • Your employer must have submitted a nomination approval request for the job to which your visa application is related.
  • If a certain licence, registration, or professional membership is required in the State or Territory where your position is located, you must already possess one or be qualified to obtain it.
  • You must meet specific Public Interest and Special Return requirements.
  • You must be in good physical and moral condition.
  • You must meet specific nomination requirements related to the visa stream you are applying for, such as holding or having held a specific subclass visa for a specific amount of time, working in your nominated occupation for a minimum amount of time, or having an occupation on the relevant list of eligible occupations.
  • For the visa stream you are applying for, you must meet certain requirements.

What Are Your Permissions Under This Visa?

With this visa, the holder is granted unconditional permanent residency in Australia. There may be dependent family members present. In Australia, the holder is free to choose where they want to live and work. Despite the fact that the visa is given based on the holder’s skill in a particular occupation, once granted, the visa does not obligate you to look for or keep a job in this field.

Who Can File a Subclass 186 Visa Application?

The Temporary Residence Transition (TRT) Stream and the Direct Entry (DE) Stream are the two streams available for the 186 – employer nomination scheme visa. The requirements vary for each stream.

You must possess a subclass 457 visa, a subclass 482 visa, or a bridging visa issued in conjunction with one of these subclasses in order to apply in the TRT stream.

You can be inside or outside of Australia and apply for the DE stream.

Stream for Direct Entry

Prior to applying, candidates in the DE stream must hold a job listed on the MLTSSL and receive a favourable skills evaluation in it. Having worked at a competent level for at least three years is necessary. Candidates for the DE stream must be younger than 45.

This visa allows employer-nominated skilled employees to reside and work permanently in Australia.

  • Your nomination must come from an Australian employer.
  • Your profession must appear on the pertinent list of qualified occupations.
  • You must speak English at least competently.

Eligibility

  • You have to be younger than 45 years old (prescribed applicants may be eligible for exemption).
  • You need to be able to speak “Competent English” (exemptions apply to UK, US, and New Zealand passport holders).
  • In a request for approval and in connection with the Direct Entry stream, your job was suggested. The
  • Minister has to give his or her approval for this nominee.
  • In regard to your designated occupation, you must have received a good skills evaluation from the applicable skills evaluating authority (prescribed applicants may be eligible for exemption).
  • You must have worked for at least three years in your chosen profession (prescribed applicants may be eligible for exemption).

Transition Stream for Temporary Residence

Those who applied for or held a 457 visa prior to 18 April 2017 and those who did so after that date are the two cohorts of candidates who are eligible to apply through the TRT stream.

This visa, likewise, allows employer-nominated skilled people to live and work continuously in Australia.

  • You must possess a 457, TSS, or similar bridging visa type A, B, or C.
  • Typically, you need to have spent at least three years working for your employer full-time.
  • Employer nomination is required.

    I trusted Parish Patience with my migration and skills assessment process and unfortunately had a very disappointing experience. Initially, I was advised by Mr Golam and Upasana to proceed with my Subclass 485 pathway. Based on their advice, I paid for skills assessment and also completed a PTE exam. However, I later found out that an important requirement for my VETASSESS application — having at least one year of relevant post-qualification work experience — had not been clearly explained to me before lodging the application. My application was submitted using work experience from before my studies and the outcome was negative. After that, I was advised that applying through Engineers Australia using the CDR pathway would be easier and would give me a better chance of receiving a positive skills assessment outcome. I followed their advice again, paid additional fees, but unfortunately received another negative outcome. During this process, two separate Subclass 485 visa applications were lodged and later withdrawn. I experienced significant financial loss through application fees, assessments, and English testing costs. I was fortunate that I still held a valid student visa, which made it possible to withdraw the applications without further complications. From my personal experience, I felt the communication, assessment of eligibility, and overall service quality were poor. I also did not receive any compensation or satisfactory resolution for the losses I experienced. I hope future clients receive clearer advice about eligibility requirements and possible risks before committing financially.
